Ade Armando Police Eddy Soeparno, MKD: Members of DPR Talking Why Reported, Don’t Understand Immunity Rights?
Member of the DPR RI and Secretary General of PAN Eddy Soeparno was officially reported to the police about his tweet which allegedly offended and defamed Ade Armando. Responding to the report, Deputy Chief Justice of the Council of Honor Habiburokhman was surprised. The reason is that, as a member of the DPR, Habiburokhman said, Eddy certainly has the right to immunity. Especially when it comes to expressing opinions.
“Yes, we did, if we reported him to the police yesterday, we are also confused, why is this member of the DPR talking about being reported, does this one understand about the right to immunity?” said Habiburokhman at the Senayan Parliament Complex, Jakarta, Tuesday (19/4/2022).
According to Habibrokhman, if cases involving members of the DPR are reported to the MKD, it is still possible. Especially regarding the alleged defamation, where the choice of words from the Council’s statement can later be investigated further.
Of course, continued Habiburokhman, the MKD will first look at the completeness of the report
Meanwhile, in substance, members of the DPR have the right to immunity. Habiburokhman said that members of the DPR in expressing their opinions and activities have freedom of speech and freedom of activity which are regulated in the Constitution and the MD3 Law.
“It’s a double cover. So it can’t be legally questioned, let alone a report made to the police. But if for example the technical question of choosing the dictions is not properly reported to the MKD, please let us check.
Ade Armando has officially reported PAN Secretary General Eddy Soeparno to the Metro Jaya Police regarding the alleged defamation. The report was made on Semelnin (18/4/2022) last night.
This was confirmed by one of Ade’s legal team, Andi Windo. He stated that the police had officially received the report.
“Yes, there is already an LP. It was reported last night. It was about defamation, slander, and false news,” Andi told reporters, Tuesday (19/4/2022).
The report is registered in the report number LP/B/1990/IV/2022/SPKT/POLDA METRO JAYA dated April 18, 2022.
In this case, Eddy was reported on suspicion of defamation and or fake news through electronic media as referred to in Article 310 of the Criminal Code and or Article 331 of the Criminal Code and or Article 14 and Article 15 of Law №1 of 1946 concerning Criminal Law Regulations and or Article 27 paragraph 3 Juncto Article 45 paragraph 3 of the Law of the Republic of Indonesia Number 19 of 2016 concerning ITE.
